Chocolate frog cards probably wouldn't count becuase it is a picture, and pictures are totally different then paintings.

could anyone just paint a picture of someone who's dead and talk to them? or is it more complicated than that? like...they have to have a spell on them to actually talk and act like said person?

It's never really been explained how the portraits work. Some of them, like Nigellus, are able to carry messages from one painting to another. I think that would be extremely useful. DD's portrait appeared in his office almost as soon as he died - how does that work? We're not told.

i suppose it's just some of Hogwart's magic working. do you think that the four founders were better wizards than Dumbledore? or is he better? because i remember they were reffered to as "the best wizards of THEIR time"

I'm thinking they probably magically tie the painting together, though it's probably tricky, which is why there aren't more people who can move between their own portraits. But I'm thinking there's just the one of Dumbledore, and Harry probably ends up asking him for one more piece of advice or something.

Well I'm sure Dumbledore's got portraits elsewhere. And I have no idea whatsoever about how they work/gain sentience.

I'm pretty sure you only get your own paintings after you die, so I don't think that was an issue.

Yea, as far as we know, photos cant talk, but a painting is an imprint of the person, not the actual person, and can give certain bits of advice.
