Daniel Handler, better known by his writing pseudonym, Lemony Snicket, has recovered a domain in a UDRP dispute at the Alternative Dispute Resolution Forum.
Handler alleged that lemony-snicket-stuff.com was registered in bad faith as [the respondent] “uses the domain name to resolve to a Japanese language website promoting the sale of a hair removal medical laser”.
Sole panellist Bruce Meyerson ruled that the disputed domain should be transferred to Handler as it was registered in bad faith.
Meyerson said: “Use of a confusingly similar domain name to divert internet users to an unrelated commercial website may not be considered a bona fide offering or fair use.”
He said that the diversion was “evidence of bad faith registration” and that the original registrant had “actual knowledge of [Handler’s] rights” when the registrant “incorporated the [Lemony Snicket] trademark exactly in the domain name”.
Meyerson ordered the domain name to be transferred to Handler.
